Acceptable Use Policy
As an Internet services provider ("ISP"), we offer our clients the means to make available web, email and other Internet services on our hardware and network. This document acts as a supplement to the Service Level Agreement applicable for the services provided by Application X, and provides a plain English guide to your rights and obligations, as well as ours. Good Manners
We cannot be your mothers, and we will not be responsible for your actions. We reserve the right to terminate any hosting agreement without notice or refund if we feel there is sufficient evidence to confirm that you are participating in activities that we consider harmful to our business reputation or the safety and security of our day-to-day operations. These activities are listed below. Bulk Mailing - Unsolicited. Bulk mailing, a.k.a. "Spam" is considered by a growing number of Internet users to be a strongly unfavorable tactic. While we philosophically have no problem with the concept of Spam, we think that there is an environment saving future in there somewhere, we cannot stand behind a client who has been identified as distributing bulk mails that are considered Spam by relevant authorities (i.e. Spam Cop), or receiving traffic at a URL that is advertised in a bulk mail message. This type of activity negatively impacts consumer attitudes towards our services, and also puts our network and other clients at risk for equipment and network disruptions. Copyright Infringement/Violation. Remember in school when cheating and plagiarism could get you in big trouble with the authorities. Well, guess what? Nothing has changed. Copyright law is as real on the Internet as it is in print medium. Hacking. Illegally accessing a network or resource carries both civil and criminal penalties under U.S. federal laws. Don't do it. Indecent, Inflammatory or Libelous Content. We consider ourselves fairly liberal and firm believers in First Amendment rights, but there are certain types of expression that we feel are not in keeping with our business or personal beliefs. Included in this is the publication of child pornography and libelous content. Its like this: if you have upset us with it, it is really in bad taste, OK. We reserve the right to review anything else you may do, whether legal or not, that we feel is harmful to our other clients, our day-to-day operations or our reputation. As we said, Application X does not take responsibility for your actions, and we are not your mothers, so we don't make it our practice to monitor your network communications to ensure that they meet our guidelines. However, if it is brought to our attention that a client is abusing our network or our goodwill, we reserve the right to take whatever action we deem appropriate to preserve our reputation, etc. We may remove the offending information, block certain protocols, or go so far as to terminate the client's contract with us. If you feel that an Application X hosted site or server is participating in any of the ugly behavior described or alluded to above, please send your concerns to our cheerful support staff and they will happily discuss your concerns and find an agreeable solution. Security
Application X is a security conscious company, and we do our best to ensure that our network is secure from intruders, viruses, random acts of god, etc. The precautions we take help to reduce your potential exposure, but nothing is 100% effective (except abstinence), so we do urge you to assume that all transmissions are insecure, and nothing works, unless otherwise indicated. We cannot assume responsibility for the security of communications through our network. We will comply with all applicable laws concerning the privacy of our client's communications. We will not intentionally monitor or disclose any e-mail messages sent or received by client accounts, unless we are required to do so by law. We do reserve the right to use automated monitoring and performance assessment tools to verify that our network is operating satisfactorily. Occasionally we may be required to disclose information transmitted over our network in order to comply with court orders, laws or government requests. Also, we reserve the right to disclose information transmitted over our network in order to protect our clients and our day-to-day operations from harm, or where we need to provide that specific level of information for the proper operation of a system or application. We cannot be held responsible for the loss of your data due to server or hardware failure. While we do backup all systems daily, we cannot guarantee the integrity of the backup because of problems archiving locked or corrupt files. It is your responsibility to initiate backups of your data at regular intervals to ensure archive integrity. We reserve the right to amend or replace this document without notice, as we deem necessary.
